Know the Impacts: Intend to Return vs. Return Uncertain
There has long been a lack of clarity about these two categories and it is important to consider your choices.
• Saying you INTEND TO RETURN does NOT mean you have to have a date or specific plan. It is simply an intent
• Selecting INTEND TO RETURN gives an overseas voter access to vote further down the ballot for Governor, State Senate, State Assembly and municipal races.
• It is at the STATE level that decisions are made about NYS voting laws. Want to know why we have to jump through hoops to send back all that paper to NYS? THAT is a NYS election law. And THAT can be changed.
• Some voters are concerned that marking off "intend to return" will alter their status with regard to state taxes. DA does NOT give specific tax advice to our members. It is always suggested that you check with a tax specialist who can advise you on your particular situation.
• However, if you do not already own a home or a business in NYS, you might want to look at a NYS Department of Taxation and Finance bulletin which outlines the criteria that lay out the criteria to be considered a resident of the state. It is thorough and informative and can be used as a guide
