BAD LEGISLATION BEING DISCUSSED IN STATE LEGISLATUREs (e.g. not adopted yet)

ARIZONA
There is a multitude of bills that have been introduced:

  • AZ’s bill provides that abortion is a felony murder of an unborn child
  • AZ’s bill introduces criminal sanctions for a partial birth abortion
  • AZ’s bill makes it a crime to coerce someone into taking abortion medication
  • AZ’s bill requires child support for preborn children
  • AZ’s bill that provides makes abortion drugs criminal

IDAHO
An ID bill gives the Idaho Attorney General the authority to prosecute abortion trafficking cases (taking anyone involved across the state line to facilitate an abortion) if the local attorney general does declines to prosecute. Penalties for violation are imprisonment for 2-5 years. The Idaho attorney general retains the authority to prosecute abortion trafficking cases if a local prosecutor declines to do so and penalties remain imprisonment for 2-5 years; 

INDIANA
IN’s bill makes taking abortion drugs a crime (wrongful death/personal injury of unborn child); it also creates the crime of manufacturing abortion drugs; citizens can report each other;

KANSAS
KS has two bills the ‘Women’s Right to Know Act’ ) requiring physicians to speak to women in a certain manner about abortion; it has been named the ‘Women Are Too Stupid’ bill.

MISSOURI
MO has a bill entitled the “Born Alive Abortion Survivors Protection Act”.

NEW HAMPSHIRE
NH’s bill prohibits government regulations re pregnancy resource centers by prohibiting any information about abortion or contraception.

OKLAHOMA
OK has an everything is anti-abortion, anti-contraception bill; save the child if possible; Any aggrieved parties, including family, can sue.

SOUTH CAROLINA
SC’s bill provides that medical abortion is a crime, with prison time and fines.

This bill, titled the "Unborn Child Protection Act," significantly restricts abortion access in South Carolina by prohibiting most abortions, including those resulting from rape or incest, and imposing severe penalties for violations. It makes it unlawful to use instruments or drugs to cause an abortion, with penalties including up to twenty years in prison and substantial fines; it also criminalizes self-induced abortions using abortion-inducing drugs.

WISCONSIN
WI has introduced a “Born Alive Bill”.

WEST VIRGINIA
WV bill prohibits using abortion medication

WYOMING
WY’s bill requires that pregnant women receive informed notices (another “Women are too stupid bill”)


LEGISLATION THAT HAS BEEN VOTED BY STATE LEGISLATURES

KANSAS
There are two bills that have passed about how to talk to women about their pregnancies (to avoid abortion etc).

SOUTH DAKOTA
SD has adopted a law to regulate abortion.  The intent of the legislation is to try to save  lives. A physician must define why an abortion was performed; only  emergencies to save the life (not the health) of the mother.

SD also adopted a law which provides that that abortion is considered to be the wrongful death of unborn child; can sue family members; sale and sending of medication abortion into the State; violations are subject to fines.

WEST VIRGINIA
WV’s bill provides that it is  a crime to deny medical treatment to victims of a  sexual offense , but does not include the right to an abortion under such circumstances.


SIGNED/ENACTED/ADOPTED

SOUTH DAKOTA
South Dakota has passed a bill aiming to save both lives (the mother and the fetus). The doctor must define why an abortion was need and can only be justified by saving the life of the mother; not the health of the mother. This legislation provides that abortion is characterized as a wrongful death of an unborn child. It has also outlawed the sending of abortion medication into the state.

WYOMING
WY has adopted a no abortion after there is a heartbeat bill.

 


BILLS THAT HAVE BEEN MODIFIED OR WITHDRAWN

KENTUCKY
KY killed its bill that established new legal protections for unborn children, making abortion a homicide, and other protections for the fetus. It also killed a bill that created criminal liability for pregnant women for fetal homicide.

NEW HAMPSHIRE
NH killed a bill that prohibited abortion referrals by public funded medical facilities.

OREGON
OR killed its born alive bill.

TENNESEE
TN killed its criminal abortion exceptions bill which had permitted an exception to protect mental/physical/ health of the mother and sex crimes. Now there are no exceptions for any circumstance.

UTAH
UT killed the no Medicaid funds for abortion providers bill.

VIRGINA
VA has four bills for a Constitutional Amendment right to reproductive freedom which ask for a voter referendum on the subject.

WYOMING
WY killed its Reproductive Freedom Act filed by the Democrat members of the state legislature.


GOOD LEGISLATION STILL BEING CONSIDERED

KENTUCKY
KS’s bill would grant pregnancy center autonomy, protecting the right to perform life-affirming care. It is unclear what this actually means.
